Our services are not for use by anyone under the age of 16.

If you register to our services you agree that you are older than 16 years.

You agree that our continued provision of services to you, and your continued use of them, represent your agreement to be bound by the Terms of Service. Referred hereinafter as 'ElasticWebinar', 'elasticwebinar.com', 'Service', 'Website', 'Platform', 'our', 'we' and 'us'; is a webinar platform provider. We reserve the right to update and change the Terms of Service from time to time without notice.

We have prepared a detailed, easy to understand privacy policy. By using our service, you agree that you have read and accepted the terms outlined in the policy. More information can be found here.

Payment

The Service is billed in advance on a monthly or annual basis.

You may cancel subscription renewal at any time and you will not be charged anymore. If you disable the subscription auto-renewal, your account may permanently lose access to some of the content such as uploaded videos, webinar statistics, webinars, etc. after the subscription expires. In some cases we might proceed with account termination.

All prices on this page are exclusive of all taxes, levies, or duties imposed by taxing authorities. We calculate the final price we collect from you on checkout page depending on your contry of residence and whether you are person or company. We collect value added tax (VAT) for Slovak people and companies and for European people. You shall be responsible for payment of all other taxes, levies, or duties.

All the prices stated by us are subject to change and may be changed from time to time at our sole discretion.

Content hosting

We claim no intellectual property rights over the material you provide to the Service. Your profile and any materials uploaded remain yours. 

You shall abide by all copyright notices. All content posted on the Service must comply with U.S. copyright law and The copyright law of the European Union.

ElasticWebinar does not actively monitor content stored on our network and servers. All content distributed by your account is the sole responsibility of you, the client. Under no circumstances will ElasticWebinar be responsible for the behaviour of our clients or their users when found to be distributing protected or illegal content. If contacted by an authority in the event of an illegal situation regarding any of the above, we will co-operate fully in any investigations they decide to make against clients found to be breaking the law.

Account Termination

You agree that we might, under certain circumstances and without prior notice terminate your account and restrict access to our service. Causes for this include but are not limited to: violations of the Terms of Service, requests by law enforcement or other government agencies and/or having provided false information as part of your account. All terminations will be made in our sole discretion and we will not be liable for any disruption or damage to you or your service that such a termination might cause. Once your account has been terminated we reserve the right to delete all the data associated with it without the option to restore it.

Limitation of liability

To the extent allowed by applicable law, in no event shall ElasticWebinar or its affiliates, directors or employees be liable for any damages whatsoever, including without limitation, any loss of profits, loss of business, loss of use or data, interruption of business, or for direct, indirect, special, incidental or consequential damages of any kind.

Acceptable use

ElasticWebinar may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, any material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Any actions intended to abuse or harm our service or lower the quality of service in any way will result in an immediate termination of your account without a refund.

You agree that if your usage of our Service is unusually high (e.g. hosting webinars for thousands of users per month with our Starter plan), we might offer you to purchase a plan upgrade for higher „limits“ or discuss with you other conditions of such high Service usage. Shall we not end up with mutual agreement of such conditions, we might impose some limits on your account (mainly, but not limited to number of registered attendees per month).

It is strictly prohibited to ask webinar attendees for their sensitive information not related to the webinar (e.g. credit card info).

You shall not hotlink videos and images hosted through our Service outside our Service.

DMCA

In the event that an Registrant believes that the Platform has been used in a manner that constitutes copyright infringement, Registrant may notify us at info@elasticwebinar.com, and provide all of the following information, as required by the Digital Millennium Copyright Act (“DMCA”):

- An electronic or physical signature of a person authorized to act on behalf of the copyright owner

- Identification of the copyrighted work that you claim has been infringed

- Identification of the material that is claimed to be infringing and where it is located on the Service

- Information reasonably sufficient to permit ElasticWebinar to contact you, such as your address, telephone number, and, email address

- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law

- A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner
